Hillz n Hollarz OHV Park has been growing for nearly a decade
Hillz n Hollarz OHV park in Kentucky has been closed without due process and without following procedures set out by the very body that created the procedures in the first place! The Henry County Board of Adjustments issued a 60 day "closure" notice so the park could "fix the problems".
Oh, the problems? You want to know what the "problems" are? Well, there are two individuals, Mr. Mike Marshall and Mr. William "Bill" Heady, who have signed affidavits claiming the following, among others:
1. The board shared that by digging existing mud holes deeper, this was a "capital improvement" to the property and a violation of my conditional use permit.
2. Trail system is not marked making it easy for guests to trespass on others land.
3. Caused a traffic jam on Hwy 389...One day August 4th...
Yeah, they dug a mud puddle deeper. Not only that, but one day they caused a... wait for it... a TRAFFIC JAM!
Sounds like Mike and Bill are going out of their way to get the park closed. Not only that, but the "board" is un-lawfully closing the park.
Section 11 of the Certificate of Land Use Restriction
Upon any violation of this conditional permit, the applicants will first be notified verbally. If the violation is not corrected, a letter will be officially sent to the applicant stating what the violation is and WHAT TO DO TO CORRECT IT. If it is still not corrected, applicants will have to appear before this Body, and the conditional use permit may be pulled.
As you can obviously see, the board simply skipped the first two steps of notification and proceeded to the last one.
