What is justice when an accident is an accident?
A deadly accident last year at Oceano Dunes left one dead and several other's with major injuries when a truck jumped over a dune and landed on an ATV with four people in it. The people in the ATV were trapped. One died, another left in a drug induced coma.
The driver of the truck was not drunk and was not under the influence at the time of the accident. Yet the families of those in the accident are going to try to get a judge to increase a sentence of 30 days in jail for the A C C I D E N T.
The families are asking for others to support them by emailing shawnbartons@yahoo.com. Support them in what? Getting "revenge"? That's what it amounts to. It was an accident.

Revenge? Are you kidding? You don't know if he was drunk or not, due to the state dropping the ball and never checking!!! How about the dui he got shortly after the accident with his kid in the car and no car seat!!!!!!!!!!!

The driver was an accident waiting for a place to happen. 3 prior complaints on his reckless driving in other areas of the dunes not to mention in the area known as the playground. Have you seen the accident report as others have or are you just piecing this together with your own after thoughts. Maybe you could call this an accident but when charges of gross neglegent vehicular manslaughter are brought against the driver with 4-5 penial sp. codes in violation you think these families are just out for revenge? I don't see it that way, they mainly are trying to keep him off the roads to keep him from injuring or killing someone else. Bet the shoe would be on the other foot if it were one of your friends or relatives. Let us pray it never happens to you as I look forward to your response and actions! Revenge, you say! Better back up and regroup if you don't know all the facts in the case. It's JUSTICE for everyone who goes over to the dunes and SAFETY for all in the future. I wish you your best thoughts to this reply.

I'm not seeking revenge, I'm wanting justice for everyone involved and for saving the lives of other people who go to the beach and are on the streets where that idiot lives.
Breaking several vehicle codes not having any respect for a human life and indangering the lives of millions of people is not worthy of probation and restitution.
As far as I'm concerned he has gone far beyond his 3 strikes all in one day on July 1, 2006.
I am the mother of Jerry Carter the man that Sean Evans killed that day. This can not be called an accident when every thing Evans was doing was breaking state laws and rules of the dunes.
One thing everyone should remember is that when a perosn is ignorant and irresponsilbe he does just that, ignorant and irresponsible things. So he must pay for what he has done. PUT HIM BEHIND BARS and with gods will he might think about what he has done, and not act like he is not guilty of anything. He KILLED an innocent man and injured 3 other people.
At least his family can see him and visit him behind bars. I get to look at a headstone and talk to grass and dirt to speak to my son.

Pat, first of all, I'm very sorry for your loss, as any parent would be. As a parent myself who enjoys being in the dunes with my family, I make the decision every single trip we make to put my entire family at risk. Just as you did with YOUR family. No, I have not seen the accident report, and from the few stories I found about it, it seems like you're going after someone who caused an accident. He wasn't drunk, he wasn't doing drugs, but he made a bad choice to (apparently) jump over a razor back and landed on top of the ATV. While it clearly ended in tragedy, I really doubt the intent of the driver was to hurt or kill anyone. If there are details you think might make a difference in my outlook, please provide them, I will take them into consideration and if necessary, I will make a correction. I have lost a brother and several friends to just this type of "accident", so don't think you're the only person who's been through it. You're not. What we do is dangerous. Always has been, always will be. If you've been here before, you'd know I"m all about safety and personal responsibility here. Hell, that's just about all I ever talk about any more. So again, I'm very sorry for your loss, but from the details I've seen, it was an accident. (BTW, trying to get him charged for something he did AFTER the fact is simply stupid.)

No one is trying to charge him for what he did after the fact. Just trying to show what type of careless individual he is. Driving drunk with a kid in the car and no car seat. No one knows if he was drunk or on drugs because the state dropped the ball and never checked. Why were they allowed to take the dash mounted camera out of the vehicle? If they weren't doing anything stupid they would have left it there. Not sure why you feel the need to defend stupidity............

You're absolutely correct: Nobody knows if he was drunk or not. If I remember correctly, this is still America where you're supposedly innocent until proven guilty. Please stop me if that's changed at all... From the sounds of it, you've already convicted him. BTW, I'd defend you from idiots attacking you for doing something stupid, too. But hey, I guess you've never done something stupid, have you? Or maybe you have, you just got lucky enough that it didn't kill someone. Either way, you probably didn't do it on purpose, did you?

If I had done this I would have apologized to the family admitted my ignorance and payed my dues!!!!!! Man Up!! I wouldn't ask for you or anyone else to defend me. Hell yes I have already convicted him!!! So I guess we are the idiots not him!!!

Difference between you and I is that I know all the details of the case and you are assuming. You know what they say about assuming........
