Edelbrock Loses Federal Suit Against Defective Carburetor
Filed in archive News on October 15, 2007
Edelbrock Corporation was found guilty of a defective carburetor in U.S. District Court on Oct. 10. The person that brought the charges against Edelbrock, Brian Latham, claimed that the carb he purchased in May of 2005 was defective. And the Federal Court believes him.
Latham claims the carb would not stop pumping fuel into the engine, causing him to lose control of the ATV and crash. I gotta tell you, I've had my fair share of wide open throttles. I've always managed to be able to think straight enough to dis engage the clutch, or kill the motor, to avoid the result that befell Mr. Latham.
Anyway, Edelbrock claims Latham installed the carburetor incorrectly, Latham said it was assembled wrong at the factory. Latham also said Edelbrock didn't tell him how to install it properly, nor did they inform him of the risks if it did get installed incorrectly. (Kind of like holding a cup of scalding hot coffee in your lap while you drive?)
Latham saidthe collision caused him to suffer personal injury and damages, including past and future pain and suffering and disfigurement, and caused him to incur substantial medical bills and a loss of income, and property damage to the ATV.
Latham's wife Nicholette is also claiming since the ATV accident she hasn't been able to get laid.
